General Terms and Conditions (T&Cs) of Boulderwald

1. Provider

2. Scope
These T&Cs apply to all contracts concluded between Boulderwald and its customers via the website or by email.
3. Services
Boulderwald offers introductory bouldering courses in the Taunus, Odenwald, Palatinate, Black Forest and Eifel regions, as well as bouldering trips to Fontainebleau and Albarracín. Individual dates are available on request by email. Bookings are made via the website, and once a booking is confirmed an invoice with a payment term of 14 days is issued. Services are provided on the booked date. The contract may be concluded in German or English.
Minors may only take part in the courses and trips with the written consent of a legal guardian.
4. Prices and Payment
All prices are stated in euros and, where applicable, include statutory value-added tax. Payment is due within 14 days of the invoice date without deduction. In the event of non-payment, Boulderwald reserves the right to cancel the booking.
5. Right of Withdrawal
Consumers have a right of withdrawal of 14 days from the conclusion of the contract. To meet the deadline, it is sufficient to send a clear statement by email in good time. In the event of a timely withdrawal, any payments already made will be refunded.
6. Cancellation and Rebooking
In principle, the customer may withdraw from the purchase contract, provided this is done before the date on which the service is to be provided. In any case, this must be done either in writing or by email. However, the provider reserves the right to charge a flat compensation fee based on the total trip price, unless a case of force majeure applies.
The basis for calculating the flat compensation fees is the date on which the provider receives the withdrawal declaration and the respective date of the trip:
- From 4 weeks before departure or earlier: 30% of the trip price
- From 2 weeks before departure: 50% of the trip price
- From 1 week before departure: 100% of the trip price
7. Minimum Number of Participants and Special Right of Termination
All trip events require a minimum number of participants:
- For all day tours, at least 3 participants
- For all 7-day trips, at least 5 participants
If this number is not reached, the provider reserves a special right of termination. The provider may cancel the event up to 12 hours before it begins. Any additional costs incurred by the customer, such as flight/train tickets, equipment, etc., must be borne by the customer. The provider accepts no liability for these. Should the provider withdraw from a trip, all customers will receive an equivalent voucher for a similar trip event in the foreseeable future. The provider endeavours in every respect to let all trip events take place.
The provider also reserves a special right of termination without notice in the event of weather conditions, illness, breaches of contract by third-party providers, as well as in the case of strict misconduct by individuals on the trip events. In the event of a special termination, all customers will receive an equivalent voucher for a similar trip event in the foreseeable future. This does not apply in the case of termination due to misconduct by the customer.
8. Disclaimer of Liability
Participation in the courses and trips is at your own risk. Boulderwald accepts no liability for injuries, accidents or damage arising during the courses or trips, unless these are due to gross negligence or intent on the part of Boulderwald. Participants are themselves responsible for their physical fitness and for adequate insurance.
9. Data Protection
Boulderwald processes personal data in accordance with the Privacy Policy. The data is used only to process the booking, perform the contract and send newsletters, provided the customer has given their consent.
10. Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr/. Boulderwald is neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.
11. Final Provisions
Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected. The law of the Federal Republic of Germany applies. The place of jurisdiction is, to the extent legally permissible, the registered seat of Boulderwald (represented by Daniel Dörr).
